Information, not legal advice.

Wales uses the Additional Learning Needs (ALN) system and Individual Development Plans (IDPs). England EHCP guidance does not apply.

Why responsibility matters

Who maintains the IDP affects who makes decisions, secures provision and issues decisions that may carry appeal rights.

Making a request

Explain why you believe local-authority responsibility is needed and include the current IDP, evidence about needs and provision, and any relevant professional advice.

If the authority refuses

Ask for the decision and reasons in writing, together with information about disagreement resolution and any right of appeal to the Education Tribunal for Wales.
