Manifestation determination review under IDEA: a parent guide

For a disciplinary change of placement, IDEA generally requires the parent, school district and relevant IEP Team members to conduct a manifestation determination within 10 school days of the decision to change placement.

When a manifestation determination is triggered

A manifestation determination is tied to a disciplinary change of placement under IDEA, not every classroom consequence or short removal. Whether a series of removals amounts to a change of placement can depend on the length, pattern and circumstances of the removals under the IDEA discipline rules.

The two federal questions

The parent, local educational agency and relevant members of the IEP Team review all relevant information and determine whether the conduct was caused by, or had a direct and substantial relationship to, the child's disability; or whether the conduct was the direct result of the agency's failure to implement the IEP.

If the behavior is a manifestation

If either condition is met, the conduct is treated as a manifestation. IDEA then requires the IEP Team to address behavioral assessment/intervention-plan requirements. Except for specified special-circumstance removals, the child generally returns to the placement from which the child was removed unless the parent and agency agree to a placement change as part of modifying the behavioral intervention plan.

How parents can prepare

Gather the IEP, behavior plans, service logs, recent evaluations, incident records, teacher communications and any information showing whether required supports were being delivered. During the meeting, keep the discussion tied to the federal manifestation questions rather than only to whether the conduct violated a school rule.
