First ask for an IDP review

An IDP must be reviewed at least every 12 months, but it can be reviewed earlier. Explain what has changed, which part of the IDP is no longer accurate or sufficient, and what evidence supports the change you are seeking.

When to request local authority reconsideration

You can ask the responsible local authority to reconsider whether the child or young person has ALN, the content of a school-maintained IDP, or whether the local authority should take over responsibility for maintaining the IDP.

What to send

Send the school decision or current IDP, relevant correspondence, concise reasons for disagreement and the evidence you want the authority to consider. Keep a complete copy of your request.

The timescale

Welsh Government guidance states that the local authority must normally make its reconsideration decision within 7 weeks of receiving the request, unless circumstances beyond its control prevent this.

After the decision

The local authority should give its decision and reasons in writing and explain information/advice services, disagreement-resolution arrangements and appeal rights. Certain local-authority decisions can then be appealed to the Education Tribunal for Wales.
