Extended School Year (ESY) services under IDEA: what parents should know

What is Extended School Year?

IDEA defines ESY as special education and related services provided beyond the normal school year, in accordance with the child’s IEP, at no cost to parents, and meeting state educational standards.

How is ESY decided?

The IEP Team must determine on an individual basis whether ESY services are necessary for the provision of FAPE. Federal regulations do not create one single national test such as a fixed regression score; states may provide additional criteria and guidance consistent with IDEA.

What limits are prohibited?

A public agency may not restrict ESY to particular disability categories or unilaterally limit the type, amount or duration of ESY services. The services should follow the child’s individual needs as determined through the IEP process.

Questions to ask the IEP Team

Ask what data the team is using, which IEP needs are at issue, what service is proposed, how often it will occur, where it will be delivered and how progress or maintenance will be reviewed. Check your state’s ESY guidance because state criteria can add detail.
