Questions to ask before an EHCP is finalised

First, know what the draft stage is

The draft EHC plan is your opportunity to comment before the local authority finalises the plan. This is not the same as having to “agree” every line before a final plan can be issued.

GOV.UK says parents or young people have at least 15 days to comment on the draft. The final plan is normally due within 20 weeks of the original assessment request, subject to statutory exceptions.

Questions about needs and provision

• Does Section B include every special educational need identified in the assessment reports?
• For each need in Section B, is there matching provision in Section F?
• Is the provision detailed and specific enough to know what will happen, how often, for how long and with what level of expertise where those details are relevant?
• If a professional recommended provision that is missing or reduced, has the local authority explained the departure from that advice?

Questions about outcomes and other sections

• Are the outcomes in Section E clear enough to review progress over time?
• Are relevant health and social care needs and provision included in Sections C, D, G, H1 or H2?
• Are the child or young person’s views, strengths, interests and aspirations represented accurately in Section A?
• Does Section K list the reports and advice gathered during the assessment?

Questions about placement and next steps

• Have you stated your school or setting preference within the draft response period?
• Have you sent your requested amendments in writing and kept a copy?
• If there are unresolved issues, have you asked the case officer for a meeting or written response explaining the local authority’s position?
